End-User License Agreement
IMPORTANT – PLEASE READ CAREFULLY: This End User License Agreement (EULA) is
a legal agreement between you and NCABANA and its affiliates. This EULA governs your use
of the ncabana.org website (the “Site) and any third-party content and services that may be
distributed therewith (collectively the “Site”). This includes and is not limited to, all and any data
and personal identifying information you choose to store or share on this site both in a public and
private capacity. NCABANA agrees to license the Site to you (personally and/or on behalf of
your employer) only if you accept all the terms contained in this EULA. By accessing or using
all or any portion of the service you accept and agree to be bound by all the terms and conditions
of this EULA. IF YOU DO NOT AGREE WITH ANY OF THE TERMS OF THIS EULA, DO
NOT USE THIS SITE AND ITS SERVICES.
You must be at least 13 years old to use the Site if enabled by a parent or legal guardian. If you
are
under 18, you represent that you have
your
parent or guardian’s permission to use the Site.
Please have them read this Agreement with you. If you are a parent or legal guardian of a user
under the age of 18, by allowing your child to use the Site, you are subject to the terms of this
Agreement and responsible for
your child’s activity on the Site.
You acknowledge and agree that the application provided on an “as is” and “as available” basis,
and that your use of or reliance upon the Site accessed thereby is at your sole risk and discretion.
NCABANA hereby disclaim any and all representations, warranties, and guarantees regarding
the Site, whether express, implied or statutory, and including, without limitation, the implied
warranties of merchantability, fitness for a particular purpose, and non-infringement.
Furthermore, NCABANA makes no warranty that (I) the Site will meet your requirements; (II)
the Site will be uninterrupted, accurate, reliable, timely, secure, or error-free; (III) the quality of
any products, services, information, or other material accessed or obtained by you through the
Site will be as represented or meet your expectations; or (IV) any errors in the Site will be
corrected.
Under no circumstances shall NCABANA be liable for any indirect, incidental, consequential,
special, or exemplary damages arising out of or in connection with your access or use of or
inability to access or use the Site, whether or not the damages were foreseeable and whether or
not NCABANA was advised of the possibility of such damages. NCABANA reserves the right
to terminate your account at any time without notice or consent.
